These Terms of Service ("Terms") govern your access to and use of Pro Pool Reports (the "Service"). By using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility & accounts
You must be at least 18 years old to use the Service. You're responsible for keeping your account credentials secure and for all activity under your account.
2. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent activity.
- Misrepresent yourself or the technician/business issuing reports.
- Upload data you don't have the right to use, or violate the privacy of others.
- Attempt to reverse-engineer, scrape, or interfere with the Service.
- Resell or sublicense the Service without our written permission.
3. Free plan & subscriptions
The Service offers a limited number of free reports. After that, continued use requires a paid subscription. Subscription fees are billed in advance through our payment processor (Stripe) and renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.
4. AI-generated content disclaimer
Reports are generated using AI based on the information you provide. While we work to make output accurate and useful, AI can produce errors or omissions. You are responsible for reviewing every report before sending it to a customer. The Service does not constitute professional advice and is not a substitute for proper water-chemistry testing, equipment inspection, or licensed pool service judgment.
5. Your content
You retain ownership of the data you enter (customer info, readings, notes) and the reports generated from it. You grant us a limited license to host, process, and display your content solely to operate the Service for you.
6. Customer data you collect
You confirm that you have the right to collect and store the customer information you save in the Service, and that you will handle it in compliance with applicable privacy laws.
7. Intellectual property
The Service, including its software, branding, and design, is owned by Pro Pool Reports and protected by intellectual property laws. These Terms grant you no ownership in the Service.
8. Service availability
We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify or discontinue features at any time.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRO POOL REPORTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Pro Pool Reports from any claims arising out of your use of the Service, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the United States and the state where Pro Pool Reports is established, without regard to conflict-of-laws principles.
